Cegos Swiss is committed, in the course of its activities and in compliance with the applicable law on data protection, to ensure the confidentiality, integrity and availability of Your personal data, as well as to respect Your privacy. The commitments described in this Privacy Policy fulfil the values, the principles of action and behaviour of Cegos Swiss and are established in compliance with Swiss law and more specifically with the Swiss Federal Act of 19 June 1992 on Data Protection.

The purpose of this Privacy Policy is to inform you of the type of personal data we collect and process, as well as the legal basis and purposes of such processing. The Privacy Policy also provides information about your rights as data subject.   

We never sell personal data and only share it with third parties when necessary as described below and only if the privacy and security of your data can be assured.

  • What Does This Notice Cover?

This Privacy Information explains how we use your personal data: how it is collected, how it is held, and how it is processed. It also explains your rights under the law relating to your personal data.

  • What is Personal Data?
Personal data is defined by the Federal low on Data Protection(235.3)  or  by General Data Protection Regulation (EU Regulation 2016/679) (the “GDPR”) as ‘any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier’.

Personal data is, in simpler terms, any information about you that enables you to be identified. Personal data covers obvious information such as your name and contact details, but it also covers less obvious information such as identification numbers, electronic location data, and other online identifiers.

We may collect some or all of the following personal data (this may vary according to your relationship with us):

6.     How Do You Use My Personal Data

Under the GDPR, we must always have a lawful basis for using personal data. This may be because the data is necessary for our performance of a contract with you, because you have consented to our use of your personal data, or because it is in our legitimate business interests to use it. Your personal data may be used for one of the following purposes:

  • Providing and managing your account.
  • Supplying our products and services to you. Your personal details are required in order for us to enter into a contract with you.
  • Improving, personalising and tailoring our products and services for you.
  • Communicating with you. This may include responding to emails or calls from you.
  • Supplying you with information by email or post (you may unsubscribe or opt-out at any time by clicking the unsubscribe link at the bottom of our email communications or replying to the email address supplied on our postal mailings).
  • With your permission and/or where permitted by law, we may also use your personal data for marketing purposes, which may include contacting you by email, telephone, text message, WhatsApp and post with information, news, and offers on our products and services. You will not be sent any unlawful marketing or spam.  We will always work to fully protect your rights and comply with our obligations under the GDPR and the Privacy and Electronic Communications (EC Directive) Regulations 2003, and you will always have the opportunity to opt-out.

We do not use automated systems for decision making, but we do use certain kinds of profiling. If at any point you wish to query any action that we take on the basis of this, the GDPR gives you the right to do so.

The following automated profiling may take place:

  • Where a diagnostic or psychometric test is included as part of an agreed learning program by a customer, participants on a learning program will be required to complete a questionnaire hosted by a third-party website in order to generate a profile. This profile will be shared with the Cegos Swiss trainer as part of a learning program.  The legal basis of processing relies on customer consent.

7.     How Long Will You Keep My Personal Data?

We will not keep your personal data for any longer than is necessary in light of the reasons for which it was first collected. Your personal data will therefore be kept for the following periods (or, where there is no fixed period, the following factors will be used to determine how long it is kept):

  • Personal data of participants enrolled on learning programs is retained for 1 year following the expiration date of a learning program. Third party processors of diagnostic testing and psychometric testing, and sub-contracted trainers adhere to the same retention periods.
  • Company name and contact data of existing customers is retained for six years following a contracted learning program.
  • Contact details and learning preferences of potential customers is retained for the legitimate business interest of communicating Cegos Swiss products and services, and is retained until it is either updated or consent to contact the recipient is withdrawn.
  • Correspondence with existing customers is held in line with Swiss legal requirements.

8.     Do You Share My Personal Data?

We may share your personal data with other companies in our group for the purposes of improving and communicating our products and services or for providing services to customers as part of an agreed training program.  This includes our holding company and its subsidiaries and partners.

We may sometimes contract with the following third parties to supply products and services to you on our behalf. These may include diagnostic or psychometric testing or survey websites for the collection of learner opinions as part of a contracted learning program, or for the purposes of delivery or marketing. In some cases, those third parties may require access to some or all of your personal data that we hold.

  • Diagnostic and Psychometric Testing companies
  • This data will be used to implement diagnostic or psychometric testing of participants on contracted Cegos Swiss learning programs
  • Printers and delivery companies located
  • This data will be used to print and ship learning materials to participants or training venues as part of Cegos Swiss learning programs.
  • Survey Providers
  • This data will be used to evaluate learner opinions and skills as part of a contractual Cegos Swiss learning program.
  • Marketing Companies
  • This data will be used to provide you with information about Cegos Swiss’s services and products

If any of your personal data is required by a third party, as described above, we will take steps to ensure that your personal data is handled safely, securely, and in accordance with your rights, our obligations, and the third party’s obligations under the law.

In some limited circumstances, we may be legally required to share certain personal data, which might include yours, if we are involved in legal proceedings or complying with legal obligations, a court order, or the instructions of a government authority.

9.     How Can I Access My Personal Data?

You have the right to request information on personal data related to You which are processed by Cegos Swiss. All request should be sent by regular mail along with a proof of identity (copy of official Identification Document with a photo mentioning Your date & place of birth), and Your contact details (phone number and email) to :

There is not normally any charge for a subject access request. If your request is ‘manifestly unfounded or excessive’ (for example, if you make repetitive requests) a fee may be charged to cover our administrative costs in responding.

We will respond to your subject access request within one month of receiving it. Normally, we aim to provide a complete response, including a copy of your personal data within that time. In some cases, however, particularly if your request is more complex, more time may be required up to a maximum of three months from the date we receive your request. You will be kept fully informed of our progress.

11.   Cookies

Cegos attaches great importance to the careful handling of personal data received from customers and website visitors. We ensure that all personal data is handled in accordance with the law.

Cegos uses data you enter :

  • To comply with your requests for information, including information relating to training courses;
  • To forward a newsletter and other informative reports;
  • To process survey data if you have registered for a survey project;
  • To carry out all activities relating to the enrolment and participation in a training course;
  • To keep you-up-to-date with regard to training courses and developments that could be of interest to you;

For all other activities and processes associated with the running of our training course business, including e-learning.

We will only use your information within the Cegos group, and will not make this data available to any third parties, unless this is your explicit wish.
